Because our tools involve sensitive subjects, we take your privacy seriously. This policy explains what information we collect, how we use it, who we share it with, and the choices you have. Please read it carefully.

1. Who We Are

This Privacy Policy explains how Jenkins & West Lindsey Street LLC, doing business as Discrimination Navigator (“Discrimination Navigator,” “we,” “us,” or “our”), collects, uses, and protects your personal information when you use the Discrimination Navigator™ website, application, and related tools and services (together, the “Services”).

This policy works together with our Terms of Service and Disclaimers.

2. Information We Collect

2.1 Information You Provide Directly

We collect information you give us, such as your name and email address when you create an account, sign up for updates, or contact us; and the contents of messages you send us through our contact form or by email.

2.2 Purchase Information

When you make a purchase, our third-party payment processor collects and processes your payment details. We do not store your full payment card number. We receive limited transaction information, such as the product purchased, the amount, the date, and confirmation of payment, which we use to fulfill and support your order.

2.3 Information You Provide Through Our Tools

When you use tools such as the charge wizard or eligibility calculator, you may enter detailed information about your employment situation. Depending on what you choose to share, this may include information that reveals sensitive characteristics, such as your race, sex, age, disability, religion, national origin, or pregnancy status, as well as your account of what happened at work. You decide what to enter, and you control whether and when you submit anything to the EEOC or any other party.

2.4 Information Collected Automatically

When you use the Services, we and our providers may automatically collect technical and usage information, such as your IP address, device and browser type, pages viewed, and the dates and times of your visits. We collect this information using cookies and similar technologies (see Section 6).

3. Sensitive Information

Because of what our tools are for, you may choose to provide sensitive personal information. We use it only to provide the Services to you. We do not sell it, and we do not share it with your employer.

You are never required to enter more than you are comfortable sharing. The information you enter into our tools is used to help you understand your situation and prepare your own documentation. We do not submit anything to the EEOC, your employer, or any court on your behalf unless you specifically use a feature designed to do so, and we share this information with service providers only as needed to operate the features you choose to use.

4. How We Use Your Information

We use the information we collect to:

  • Provide, operate, and maintain the Services
  • Process your purchases and deliver your products
  • Send you transactional messages, such as order confirmations, account notices, and support responses
  • Respond to your questions and requests
  • Send you marketing or update emails where you have signed up or otherwise consented (you can opt out at any time)
  • Improve and secure the Services and prevent fraud or misuse
  • Comply with our legal obligations and enforce our Terms of Service

5. How We Share Your Information

We do not sell, rent, or trade your personal information.

We share personal information only in these limited circumstances:

  • Service providers. We use trusted third parties to help us operate the Services, including a payment processor, an email delivery provider, a hosting provider, and similar vendors. They may access personal information only to perform services for us and are required to keep it confidential.
  • Legal and safety. We may disclose information if required by law, or if we believe in good faith that disclosure is necessary to comply with legal process, protect our rights, or protect the safety of any person.
  • Business transfers. If we are involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction, subject to this policy.

Payments are processed by Stripe, and your payment information is handled under Stripe’s own privacy practices.

6. Cookies and Tracking Technologies

We use cookies and similar technologies to operate the Services, remember your preferences, keep your cart and session working, and understand how the Services are used. You can control or disable cookies through your browser settings, but some features may not work properly if you do.

7. Data Retention

We keep your personal information for as long as needed to provide the Services, fulfill the purposes described in this policy, comply with our legal obligations, resolve disputes, and enforce our agreements. When information is no longer needed, we take reasonable steps to delete or de-identify it.

8. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect your personal information against unauthorized access, alteration, disclosure, or destruction. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.

9. Your Privacy Choices and Rights

Subject to applicable law, you may have the right to:

  • Access the personal information we hold about you
  • Correct inaccurate information
  • Request deletion of your information
  • Opt out of marketing communications

To exercise any of these rights, email us at contact@discriminationnavigator.com. We will respond as required by applicable law. Depending on where you live, you may have additional rights under your state’s privacy laws, and we will honor those rights where they apply.

10. Marketing Communications

If you have signed up to receive updates or marketing emails from us, you can opt out at any time by using the unsubscribe link in any such email or by contacting us. We will still send you non-marketing messages related to your account or purchases.

11. Children’s Privacy

The Services are intended for adults 18 and older. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us and we will take appropriate steps to delete it.

12. Where Your Information Is Processed

We are based in the United States, and the Services are operated and hosted in the United States. If you access the Services from outside the United States, you understand that your information will be processed in the United States, where data protection laws may differ from those in your location.

13. Third-Party Links

The Services may link to third-party websites and resources, including government agencies such as the EEOC. We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies.

14. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will update the effective date at the top of this policy and may provide additional notice. Your continued use of the Services after the changes take effect means you accept the updated policy.
